Terms of assembly of Huber Technik GmbH & Co. KG, Erding
§1 Scope of application
- The following terms of assembly apply to assembly, commissioning, acceptance, maintenance, inspections, repairs and similar. In the following, for the sake of simplicity, we will only refer to “assembly”.
- Our terms of assembly are valid exclusively in conjunction with our terms of delivery and payment; we do not recognise any provisions to the contrary or any provisions deviating from our terms and conditions unless we expressly agree to their validity. Our terms are also valid if we carry out the installation without reservation in the knowledge of terms and conditions of the customer that conflict with or deviate from our terms and conditions. UN law is expressly excluded.
- In case of doubt, the German text of the terms of assembly is always decisive.
§2 Assembly kits
The enclosed assembly rates are the currently valid assembly rates. We reserve the right to invoice the installation according to the currently valid installation rates.
§3 Invoicing
- The installation costs shall be invoiced after the installation has been completed or by means of partial invoices in the case of longer installations.
- Voluntary services provided by the customer to the installation personnel which have not been agreed with us shall not be taken into account in the invoice
- The agreed amounts are net without value added tax, which the customer must reimburse at the respective statutory rate.
- All assembly invoices are payable without deduction.
- With regard to payment, § 4 of our terms and conditions shall apply accordingly.
§4 Travel costs
- The travel costs shall be calculated at the kilometre rate determined by us.
- Our fixed travel time rate of 85% of the working time shall apply to the travel time.
- Any travelling time outside normal working hours (cf. §5 No. 1) will be charged at a surcharge of 25%. In addition, a night surcharge of 25% will be levied for the period between 8 p.m. and 6 a.m.
- A surcharge of 50% will be levied for travel times on Saturdays
- A surcharge of 100% will be levied for travel times on Sundays and public holidays.
- A surcharge of 150% shall be levied for driving time on high public holidays (Easter Sunday, Labour Day, Whit Sunday, Christmas Day).
§5 Working hours
- The normal working time is 40 hours and is distributed as follows:
Monday to Thursday 07:00 a.m to 4:30 p.m.
Friday 07:00 a.m. to 12:00 p.m.
- Preparation time shall be charged as working time.
- Waiting times at the client’s premises are considered working time.
- Any working hours outside normal working hours will be charged with a surcharge of 25%. In addition, a night surcharge of 25% shall be charged for the period between 8 p.m. and 6 a.m.
- A surcharge of 50% shall be levied for working time on Saturdays.
- A surcharge of 100% will be levied for travel times on Sundays and public holidays.
- A surcharge of 150% shall be levied for driving time on high public holidays (Easter Sunday, Labour Day, Whit Sunday, Christmas Day).
§6 Overnight expenses
Overnight accommodation costs shall be charged according to actual expenditure, but at least at the rate stated in the assembly rates.
§7 Expense
Expense is due for 8 hours or more of travel and/or working time. The expense amount doubles as soon as the assembly/travel takes longer than 24 hours. The expense shall also be paid for Saturdays, Sundays and public holidays on which no work is done, if these days fall within the entire assembly period.
§8 Other costs
- Lifting equipment not provided by the principal shall be organised by the contractor. The costs incurred for this shall be charged to the principal.
- Material required by the contractor for the assembly (spare parts, purchased parts, etc.) shall be invoiced to the principal at the normal conditions.
- In the case of rail or air travel, the costs for passenger transport as well as for luggage and tool transport, costs for hire cars, taxis, buses or similar will be invoiced to the client.
