Mounting Conditions of the company Huber Technik GmbH & Co. KG, Erding

In the following, we will draw your attention to our current mounting conditions.

 

§1 Scope of application
  1. The following mounting conditions apply to assembly, commissioning, acceptance, maintenance, revisions, repairs and the like. In the following, for the sake of simplicity, we will only refer to “assembly”.
  2. Our Terms and Conditions of Mounting shall apply exclusively in conjunction with our General Terms and Conditions; we do not recognize any provisions to the contrary or any provisions deviating from our Terms and Conditions unless we expressly agree to their validity. Terms and conditions shall also apply if we carry out the installation without reservation in the knowledge of conflicting or deviating terms and conditions of the customer. UN law is expressly excluded.
§2 Mounting kits

The enclosed mounting kits are the currently valid mounting kits. We reserve the right to invoice the installation according to the currently valid installation rates.

§3 Invoicing
  1. The invoicing of the installation costs shall be carried out after the installation has been completed or by means of partial invoices in the case of longer installations.
  2. Voluntary services provided by the customer to the mounting personnel, which have not been agreed with us, will not be taken into account in the invoice.
  3. The agreed amounts are net without value added tax, which the customer must pay at the respective statutory rate.
  4. All mounting invoices are payable without deduction.
  5. With regard to payment, §4 of our General Terms and Conditions shall apply accordingly.
§4 Travel costs
  1. Travel costs shall be charged at the mileage rate determined by us.
  2. For the travel time our fixed travel time rate of 85% of the working time applies.
  3. Any travel time outside the normal working hours (see §5 No. 1) will be charged with a surcharge of 25%. In addition, a night surcharge of 25% will be charged between 20:00 and 06:00.
  4. For travel times on Saturdays, a surcharge of 50% will be applied.
  5. For travel times on Sundays and public holidays, a surcharge of 100% will be charged.
  6. For travel times on high holidays (Easter Sunday, Labor Day, Pentecost Sunday, Christmas holidays) a surcharge of 150% will be charged.
§5 Working time
  1. The normal working time is 40 hours and is distributed as follows: Monday to Thursday 07:00 to 16:30 Friday 07:00 to 12:00
  2. Preparation time is charged as working time.
  3. Waiting time at the client’s premises is considered working time.
  4. Any working hours outside the normal working hours will be charged with a surcharge of 25%. In addition, a night surcharge of 25% will be charged for the time between 20:00 and 06:00.
  5. For working time on Saturdays, a surcharge of 50% will be charged.
  6. For working time on Sundays and public holidays a surcharge of 100% will be charged.
  7. For working time on high holidays (Easter Sunday, Labor Day, Pentecost Sunday, Christmas holidays) a surcharge of 150% will be charged.
§6 Overnight expenses

Accommodation costs will be invoiced according to actual expenditure, but at least at the rate stated in the assembly rates.

§7 Triggering

Triggering shall be due from 8 hours of travel and/or working time. The payment amount doubles as soon as the mounting /travel takes longer than 24 hours. The allowance shall also be paid for Saturdays, Sundays and public holidays on which no work is performed, if these days fall within the entire mounting period.

§8 Other costs
  1. Lifting equipment not provided by the Client shall be organized by the Contractor. The costs incurred for this shall be charged to the Customer.
  2. Material required by the Contractor for the assembly (spare parts, purchased parts, etc.) shall be invoiced to the Customer at the normal conditions.
  3. In the case of rail or air travel, the costs for passenger transport as well as for luggage and tool transport, costs for rental cars, cabs, buses or similar will be invoiced to the client.
